Welcome to Foodfy ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of the Foodfy platform, including our website at foodfy.ai, mobile applications for iOS and Android, application programming interfaces (APIs), merchant dashboards, point-of-sale systems, kitchen display systems, website and mobile app builders, AI-powered tools, drone delivery infrastructure, and all related services, features, content, and functionality (collectively, the "Platform").

2. परिभाषाएं

Throughout these Terms, the following definitions apply:

  • प्लेटफार्म: The Foodfy website, mobile applications, APIs, merchant dashboards, embedded tools (POS, KDS, website builder, app builder, ScreensCaster), AI services, drone delivery network, and all associated services, features, and infrastructure operated by Foodfy.

  • गाह्क: इक माह् नू जेह् ड़ा प्लेटफार्म दा उपयोग व्यावसायिक भागीदारें थमां उत्पाद ते सेवाएं गी ब्राउज़ करने, खोज करने, आर्डर करने जां खरीदने लेई करदा ऐ, जिंदे च वेब, मोबाइल ऐप, QR कोड, स्व-सेवा कियोस्क, जां त्रीयें पार्टी दी डिलीवरी इंटीग्रेशनें दे राहें बी शामल ऐ।
  • बिजनेस पार्टनर: कोई बी रेस्तरां, किराना स्टोर, फार्मेसी, फुल्लें दी दुकान, खुदरा स्टोर, सप्लायर, ब्रांड, डार्क किचन, जां होर व्यावसायिक इकाई जेह् ड़ी प्लेटफार्म पर उत्पादें जां सेवाएं दी सूची बनांदी ऐ, फूडफी तकनीकी उपकरणें दा इस्तेमाल करदी ऐ, जां फूडफी बजार च हिस्सा लैंदी ऐ।
  • डिलीवरी पार्टनर: इक माह् नू जां इकाई जेह् ड़ी प्लेटफार्म दे राहें डिलीवरी सेवां प्रदान करदी ऐ, चाहे ओह् परंपरागत गड्डी आह् ली डिलीवरी दे राहें होऐ जां फूडफी ड्रोन डिलीवरी नेटवर्क दे राहें।
  • Territory Partner: इक माह् नू जां इकाई जेह् ड़ी इक निर्धारत भौगोलिक क्षेत्र दे अंदर फूडफी दे संचालन दा प्रबंधन करदी ऐ, जेह् ड़ी पंज स्तरें च इक च संचालित होंदी ऐ: क्षेत्र प्रमुख, देश प्रमुख, राज्य प्रमुख, शहर प्रमुख, जां क्षेत्र प्रमुख।
  • कारपोरेट खाता: फूडफी फॉर वर्क च दाखले आह् ला इक संगठन जेह् ड़ा अपने कर्मचारियें गी प्री-फंड डिजिटल बटुआ, समूह आर्डर, ते प्लेटफार्म पर खर्च प्रबंधन दे माध्यम कन्नै खाने दे फायदे प्रदान करदा ऐ।
  • फूडफी गोल्ड: The Platform subscription membership program that provides Customers with benefits including free delivery, order discounts, priority support, and other premium features.
  • न्यूट्रीलाइफ: The Platform health and nutrition tracking service that enables users to log meals, track calories and macronutrients, record biometric data, and receive AI-powered nutritional guidance.
  • ए आई सेवाएं: प्लेटफार्म दे राहें उपलब्ध करोआए गेदे सारे आर्टिफिशियल इंटेलिजेंस ते मशीन लर्निंग फीचर, जिंदे च फूडफी एआई हब, चैटबॉट, मेनू अनुकूलन, मंग पूर्वानुमान, स्वचालित विपणन, पोशण विश्लेषण, ते एआई संचालित ग्राहक समर्थन शामल न पर इसदे तगर सीमित नेईं ऐ।
  • ड्रोनपोर्ट: फूडफी ड्रोन डिलीवरी नेटवर्क दे अंदर इक निर्धारित भौतिक थाह् र जेह् ड़ा ड्रोन आह् ली डिलीवरी लेई रिले बिंदु दे रूप च कम्म करदा ऐ, जेह् ड़ा फूडफी कन्नै समझौते दे तैह् त मेजबानें आसेआ चलाया जंदा ऐ।
  • समग्गरी: प्लेटफार्म दे राहें उपलब्ध करोआए गेदे सारे पाठ, छवि, ग्राफिक्स, फोटो, ऑडियो, वीडियो, डेटा, सॉफ्टवेयर, जानकारी, ते होर समग्गरी।
  • User Content: प्लेटफार्म दे राहें बरतूनी आसेआ जमा कीती गेदी, पोस्ट कीती गेदी जां प्रसारित कीती गेदी कुसै बी सामग्री, डेटा, पाठ, छवि, समीक्षा, रेटिंग, जां होर समग्गरी।

3. पात्रता दा

To access or use the Platform, you must meet all of the following requirements:

  • घट्ट शा घट्ट 18 साल दी उम्र होनी चाहिदी, जां अपने अधिकार क्षेत्र च कानूनी तौर पर बहुसंख्यक उम्र होनी चाहिदी, जेह्ड़ी बी मती होऐ।

  • Provide accurate, current, and complete information during the registration process and maintain the accuracy of such information.
  • Not have been previously suspended, removed, or permanently banned from the Platform.
  • Not be located in, or a resident of, any jurisdiction where use of the Platform would violate applicable local, national, or international law.

प्लेटफार्म दा इस्तेमाल करियै, तुस इस गल्लै दा प्रतिनिधित्व करदे ओ ते वारंट करदे ओ जे तुस सब्भै पात्रता दी शर्तें गी पूरा करदे ओ। Foodfy गी कुसै बी समें उप्पर तुंदी पात्रता दा सत्यापन करने दा अधिकार सुरक्षित ऐ ते जेकर एह् शर्तें गी पूरा नेईं कीता जंदा तां एक्सेस थमां मना करने जां रद्द करने दा अधिकार ऐ।

4. खाता पंजीकरण ते सुरक्षा

To access certain features of the Platform, you must create an account. When you register, you agree to:

  • Provide truthful, accurate, and complete registration information, including your legal name, valid email address, and phone number.
  • इक मजबूत पासवर्ड बनाओ ते अपने लॉग इन क्रेडेंशियल्स दी सख्त गोपनीयता बनाई रक्खो.

  • Notify Foodfy immediately at [email protected] if you become aware of any unauthorized access to or use of your account.

  • Not share your account credentials with any other person or allow multiple individuals to use a single account, unless the account type expressly permits multiple users (e.g., Business Partner staff accounts).

Foodfy गी कुसै बी खाते गी निलंबित जां समाप्त करने दा अधिकार सुरक्षित रखदा ऐ जेह् ड़ा असेंगी उचित रूप कन्नै मन्नेआ जंदा ऐ जे इनें शर्तें दा उल्लंघन करियै बरतेआ जा करदा ऐ, धोखाधड़ी आह् ली गतिविधि च शामल ऐ, जां प्लेटफार्म जां होर बरतूनी आस्तै सुरक्षा जोखिम पैदा करदा ऐ।

5. प्लेटफार्म सेवाएं

फूडफी इक तकनीकी मंच प्रदान करदा ऐ जेह् ड़ा ग्राहकें गी रेस्तरां, किराने स्टोर, फार्मेसी, फुल्लें दी दुकानें, ते खुदरा स्टोरें समेत मते सारे ऊर्ध्वाधरें च मकामी कारोबार कन्नै जोड़दा ऐ। अस खोज, आर्डर, भुगतान, ते डिलीवरी प्रक्रिया गी सुविधाजनक बनांदे आं। Foodfy इक तकनीकी बिचौलियें दे रूप च कम्म करदा ऐ ते बिजनेस पार्टनरें आसेआ सूचीबद्ध उत्पादें जां सेवाएं दा विक्रेता, निर्माता जां प्रदाता नेईं ऐ। हर इक बिजनेस पार्टनर अपनी पेशकश दी गुणवत्ता, सुरक्षा, वैधता, सटीकता, ते पूर्ति आस्तै स्वतंत्र ते इकमात्र जिम्मेदार ऐ।

ग्राहक फूडफी वेबसाइट, मोबाइल ऐपलीकेशन, क्यूआर कोड टेबल आर्डरिंग, भागीदारी आह् ले थाह् रें पर स्व-सेवा कियोस्क, ते समेकित त्रीयें पार्टी डिलीवरी प्लेटफार्में दे राहें मते सारे चैनलें राहें प्लेटफार्म गी एक्सेस करी सकदे न।

5.2 बिजनेस पार्टनर आस्तै

फूडफी बिजनेस पार्टनरें गी इक व्यापक, आल-इन-वन टेक्नोलॉजी सूट उपलब्ध करोआंदा ऐ जेह् ड़ा उंदे संचालन गी डिजिटल ते अनुकूल बनाने लेई डिजाइन कीता गेदा ऐ। इस च शामल न, पर एह्दे तगर सीमित नेईं ऐ: क्लाउड प्वाइंट-ऑफ-सेल (पीओएस) सिस्टम, किचन डिस्प्ले सिस्टम (केडीएस), मेनू ते इन्वेंटरी प्रबंधन, वफादारी प्रोग्राम कन्नै ग्राहक रिश्ते प्रबंधन (सीआरएम), एआई-संचालित एनालिटिक्स ते डिमांड पूर्वानुमान, वेबसाइट ते मोबाइल ऐप बिल्डर, डिजिटल साइनेज (ScreensCaster), इवेंट ते टिकट प्रबंधन, आरक्षण ते होस्ट स्टेशन, खरीद प्रबंधन, दस्तावेज तिजोरी, कर्मचारी ते एचआर प्रबंधन, खर्च ट्रैकिंग, लेखा एकीकरण, ओमनीचैनल संदेश (व्हाट्सएप, एसएमएस, ईमेल), विज्ञापन ते विपणन स्वचालन, प्रभावशाली प्रबंधन, ग्राहक सर्वेक्षण, स्व-सेवा कियोस्क सॉफ्टवेयर, क्यूआर कोड आर्डरिंग, डिलीवरी प्लेटफार्म इकीकरण, भुगतान टर्मिनल एकीकरण, ते फ्रेंचाइजी प्रबंधन।

बिजनेस पार्टनर अपने ग्राहक डेटा, आर्डर इतिहास, ते प्लेटफार्म दे राहें पैदा कीते गेदे बिजनेस एनालिटिक्स दी पूरी स्वामित्व बरकरार रखदे न। Foodfy बिजनेस पार्टनर डेटा दी स्वामित्व दा दावा नेईं करदा ते डेटा निर्यात ते पोर्टेबिलिटी आस्तै उपकरण उपलब्ध करोआंदा ऐ।

5.3 डिलीवरी पार्टनर आस्तै

डिलीवरी पार्टनर स्वतंत्र ठेकेदार दे रूप च कम्म करदे न ते फूडफी दे कर्मचारी, एजेंट, जां प्रतिनिधि नेईं न। फूडफी डिलीवरी अनुरोधें, रूट अनुकूलन, ते आर्डर ट्रैकिंग गी सुविधाजनक बनाने लेई तकनीकी मंच उपलब्ध करोआंदा ऐ। फूडफी ते डिलीवरी पार्टनर दे बश्कार रिश्तें गी नियंत्रत करने आह् ली विशेश शर्तें गी बक्ख-बक्ख डिलीवरी पार्टनर समझौते च दित्ता गेआ ऐ, जिसी डिलीवरी करने थमां पैह् ले स्वीकार कीता जाना लोड़चदा ऐ।

डिलीवरी पार्टनर अपने अधिकार क्षेत्र च उचित बीमा, वैध लाइसेंस, ते सब्भै लागू परिवहन ते डिलीवरी नियमें दा पालन करने लेई इकमात्र जिम्मेदार न।

5.4 टेरिटरी पार्टनर आस्तै

Territory Partners manage Foodfy operations within designated geographic areas under the terms of a separate Territory Partner Agreement. Territory Partners operate at one of five hierarchical levels: Region Head, Country Head, State Head, City Head, or Area Head. Each level carries specific responsibilities, performance obligations, and profit-sharing arrangements as detailed in the applicable Territory Partner Agreement.

Territory Partner positions are subject to availability, performance review, and compliance with Foodfy operational standards. Foodfy reserves the right to modify territory boundaries, reassign territories, or terminate Territory Partner agreements in accordance with the applicable agreement terms.

Organizations enrolled in Foodfy for Work receive access to corporate meal management tools, including pre-funded employee digital wallets, group ordering capabilities, expense tracking and reporting, and integration with HR systems. Corporate Account administrators are responsible for managing employee access, funding allocations, and ensuring compliance with their organization internal expense policies.

The Platform provides features for accredited investors to explore investment opportunities in the Foodfy ecosystem, including direct investment in Foodfy, DronePort infrastructure, and related ventures. All investment activities are subject to applicable securities laws and regulations. Investment features on the Platform do not constitute financial advice, and Users should consult qualified financial advisors before making investment decisions. Access to investment features may require additional identity verification and accreditation checks.

5.7 प्रभावशाली लोकें लेई

The Platform provides tools for content creators and influencers to collaborate with Business Partners on promotional campaigns. Influencer activities are governed by the Influencer Program Terms and must comply with all applicable advertising disclosure laws and regulations, including requirements to clearly disclose sponsored content and material connections.

When you place an order through the Platform, the following terms apply:

  • You agree to pay the full price for all items ordered, including the listed product price, applicable taxes, service fees, delivery charges, and any gratuity you choose to add.
  • Product prices are set independently by Business Partners. Foodfy does not mark up product prices and does not control the pricing decisions of Business Partners.
  • Payment is processed securely through our PCI DSS-compliant third-party payment processors, including Stripe. Foodfy does not store your full payment card number, CVV, or other sensitive payment credentials on our servers.
  • Orders are subject to acceptance by the Business Partner. A Business Partner may decline an order due to capacity constraints, inventory unavailability, operating hours, delivery distance, or other legitimate reasons.

  • Refund and cancellation policies vary by Business Partner, order type, and the stage of order processing. Refund requests are evaluated on a case-by-case basis considering factors such as the reason for the request, time elapsed, and order status.
  • Foodfy for Work कार्पोरेट बटुए दे राहें कीते गेदे आर्डर आस्तै, भुगतान तुंदे नियोक्ता आसेआ फंड कीते गेदे बटुआ बैलेंस थमां कट्टी लैता जंदा ऐ। कार्पोरेट बटुआ दी शर्तें गी फूडफी ते तुंदे नियोक्ता दे बश्कार समझौते कन्नै नियंत्रत कीता जंदा ऐ।
  • Tips and gratuities are voluntary and are passed through to Delivery Partners or Business Partner staff in full. Foodfy does not retain any portion of tips.

7. प्लेटफार्म दी फीस

फूडफी अपनी तकनीक ते बजार सेवाएं दे इस्तेमाल लेई बिजनेस पार्टनरें थमां प्लेटफार्म फीस लैंदा ऐ। शुल्क संरचना गी पारदर्शी ते प्रतिस्पर्धी बनाने लेई बनाया गेआ ऐ:

  • फूडफी बजार दे राहें कीते गेदे आर्डर लेई बजार प्लेटफार्म फीस दी सीमा आर्डर वैल्यू दे ज़्यादा शा ज़्यादा 10% पर कीती जंदी ऐ।
  • अपने खुद दे सीधे आर्डर लेई (अपनी ब्रांडेड वेबसाइट जां फूडफी पर बने दे ऐप दे माध्यम कन्नै) फूडफी तकनीक दा इस्तेमाल करने आह् ले बिजनेस पार्टनर गी उंदे बिजनेस पार्टनर समझौते च निर्दिश्ट प्लेटफार्म शुल्क च घट्ट कीता जंदा ऐ।
  • एआई सेवाएं दा बिल पे-एज-यू-गो क्रेडिट सिस्टम पर कीता जंदा ऐ। एआई क्रेडिट पैह् ले थमां गै खरीदेआ जंदा ऐ ते बरतून दे आधार उप्पर खपत कीता जंदा ऐ। क्रेडिट कीमतें ते खपत दरें गी एआई सेवाएं दी कीमत निर्धारण पृष्ठ पर प्रकाशत कीता जंदा ऐ ते इसगी पैह् ले थमां गै अपडेट कीता जाई सकदा ऐ।
  • फूडफी गोल्ड सदस्यता शुल्क सदस्यता लैने आह् ले ग्राहकें थमां लैता जंदा ऐ जिसी धारा 8 च विस्तार दित्ता गेआ ऐ।
  • Foodfy for Work कार्पोरेट खाते दी फीस, जेकर लागू ऐ तां, बक्ख-बक्ख कारपोरेट सेवाएं दे समझौते कन्नै नियंत्रत कीती जंदी ऐ।

ग्राहकें थमां चेकआउट पर प्रदर्शत कीमतें शा मती प्लेटफार्म फीस नेईं लैती जंदी ऐ। सब्भै फीस, शुल्क, ते लागू कर आर्डर दी पुष्टि थमां पैह् ले साफ तौर पर आइटम कीते जंदे न।

8. फूडफी गोल्ड दी सदस्यता

फूडफी गोल्ड इक सशुल्क सदस्यता सदस्यता प्रोग्राम ऐ जेह् ड़ा ग्राहकें गी प्रीमियम फायदे प्रदान करदा ऐ। Foodfy Gold दी सदस्यता लैने कन्नै, तुस निम्नलिखित शर्तें कन्नै सहमत ओ:

8.1 सदस्यता ते बिलिंग

  • फूडफी गोल्ड सदस्यताएं गी खरीदने दे समें च चुने गेदे आधार उप्पर बार-बार (मासिक जां सालाना) बिल कीता जंदा ऐ। हर बिलिंग अवधि दे अंत च तुंदी सदस्यता स्वतः नवीनीकरण होई जाग, जदूं तकर तुस नवीकरण दी तरीक थमां पैह् ले रद्द नेईं करी लैंदे ओ।
  • Payment is processed through Stripe. By subscribing, you authorize Foodfy to charge your designated payment method for the subscription fee at each renewal period.
  • Subscription prices may change with at least 30 days advance notice. Price changes will take effect at the start of your next billing cycle following the notice period.

8.2 फायदे

  • फूडफी गोल्ड दे फायदें च मुफ्त जां छूट आह् ली डिलीवरी, आर्डर पर प्रतिशत छूट, प्राथमिकता आह् ले ग्राहक समर्थन, नमें फीचरें तगर जल्दी पुज्ज, ते खास प्रचार शामल होई सकदे न। विशेश फायदे योजना दे स्तर ते भौगोलिक उपलब्धता दे अनुसार बक्ख-बक्ख होंदे न।
  • फायदे सिर्फ फूडफी प्लेटफार्म दे राहें कीते गेदे पात्र आर्डर पर लागू होंदे न ते इसदे अधीन न्युनतम आर्डर मूल्यें, भागीदारी करने आह् ले बिजनेस पार्टनर दी उपलब्धता, ते होर शर्तें दे अधीन होंदे न जि’यां निर्दिश्ट कीता गेआ ऐ।
  • Foodfy गी सब्सक्राइबरें गी उचित अग्रिम सूचना देइयै विशिश्ट फायदें गी संशोधित करने, जोड़ने जां हटाने दा अधिकार सुरक्षित ऐ।

8.3 परीक्षण दी अवधि

फूडफी नमें फूडफी गोल्ड सब्सक्राइबरें लेई मुफ्त जां छूट आह् ली परीक्षण अवधि दी पेशकश करी सकदा ऐ। परीक्षण अवधि दे अंत च, तुंदी सदस्यता अपने आप गै उस बेल्लै दी मौजूदा दर पर भुगतान कीती गेदी सदस्यता च बदली जाग, जदूं तकर जे तुस परीक्षण अवधि दे समाप्त होने थमां पैह् ले रद्द नेईं करदे ओ। तुस हर खाते च सिर्फ इक परीक्षण दा इस्तेमाल करी सकदे ओ।

8.4 रद्द करना ते वापसी

  • You may cancel your Foodfy Gold subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period, and you will retain access to Gold benefits until that date.
  • No prorated refunds are provided for partial billing periods. If you cancel during a trial period, you will not be charged.
  • जेकर अस इनें शर्तें दा दुरुपयोग, धोखाधड़ी, जां उल्लंघन दा पता लाने आं तां Foodfy गी गोल्ड सदस्यता गी समाप्त करने जां निलंबित करने दा अधिकार सुरक्षित ऐ।

8.5 खाता प्रतिबंध

फूडफी गोल्ड दी सदस्यता निजी ते गैर-हस्तांतरण योग्य ऐ। खाता बंड, पुनर्विक्रय, जां व्यावसायिक उद्देशें लेई सोने दे फायदें दा उपयोग करने पर सख्त मनाही ऐ ते इसदे फलस्वरूप बिना वापसी दे सदस्यता गी फौरन समाप्त करी सकदा ऐ।

9. फूडफी फॉर वर्क (कार्पोरेट खाते)

फूडफी फॉर वर्क संगठनें गी प्लेटफार्म दे राहें अपने कर्मचारियें गी खाने दे फायदे देने च सक्षम बनांदा ऐ। निम्नलिखित शर्तें लागू होंदियां न:

  • कार्पोरेट खाते दी शर्तें, जिंदे च कीमत निर्धारण, बटुआ फंडिंग शेड्यूल, ते आबंटन सीमा शामल न, फूडफी ते नामांकन संगठन दे बश्कार कम्मै आस्तै बक्ख-बक्ख फूडफी समझौते कन्नै नियंत्रत कीतियां जंदियां न।

  • Use the Platform to compile, directly or indirectly, a collection of business listings, product data, pricing information, or customer data for use outside the Platform.

23. वारंटी अस्वीकरण

THE PLATFORM AND ALL CONTENT, FEATURES, SERVICES, AI OUTPUTS, NUTRITIONAL DATA, AND INFORMATION PROVIDED THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOODFY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

Without limiting the foregoing, Foodfy does not warrant that: (a) the Platform will be uninterrupted, timely, secure, or error-free; (b) the results obtained from use of the Platform will be accurate, reliable, or complete; (c) any errors or defects will be corrected; (d) the Platform or the servers that make the Platform available are free of viruses or other harmful components; or (e) AI-generated content, nutritional data, or health insights are accurate or suitable for any particular purpose.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOODFY, ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to access or use the Platform.

THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF FOODFY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless Foodfy and its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, partners, and licensors (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys fees and court costs) arising out of or in connection with:

  • Your access to or use of the Platform.
  • Your violation of these Terms or any applicable law or regulation.
  • Your User Content or business listings.
  • Your violation of any rights of any third party, including intellectual property, privacy, or publicity rights.

26. विवाद दा समाधान

26.1 अनौपचारिक संकल्प करना

जेकर विवाद गी तीस (30) दिनें दे अंदर अनौपचारिक वार्ता दे माध्यम कन्नै हल नेईं कीता जाई सकदा तां कुसै बी पक्ष विवाद पर लागू अधिकार क्षेत्र च मान्यता प्राप्त मध्यस्थता संस्थान आसेआ प्रबंधत बाध्यकारी मध्यस्थता दे माध्यम कन्नै विवाद दा समाधान करने दा विकल्प चुन सकदा ऐ। मध्यस्थता इक गै पंच, अंग्रेजी भाशा च कीती जाग, ते फैसला अंतिम ते दौनें पक्षें लेई बाध्यकारी होग।

26.3 वर्ग कार्रवाई माफी

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Foodfy.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the relevant Foodfy entity operates, without regard to conflict of law principles. As Foodfy operates across multiple countries through its Territory Partner network, the specific governing law and jurisdiction may vary depending on your location, the nature of the dispute, and the Foodfy entity with which you have a contractual relationship.

28. समाप्ति करना

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without prior notice. Grounds for termination include, but are not limited to:

  • Violation of these Terms or any other Foodfy policy or agreement.

  • Prolonged inactivity of your account.

Upon termination: (a) your right to use the Platform immediately ceases; (b) we may delete your account data after a reasonable retention period, subject to our Privacy Policy and applicable legal obligations; (c) any outstanding payment obligations survive termination; and (d) provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 20, 21, 23, 24, 25, 26, 27, and 29-33.

Foodfy इनें शर्तें दे तैह् त अपने दायित्वें दे निष्पादन च कुसै बी विफलता जां देरी आस्तै जिम्मेदार नेईं होग जिस हद तकर इस चाल्ली दी असफलता जां देरी अपने उचित नियंत्रण थमां बाह् र परिस्थितियें दे कारण होंदी ऐ, जिंदे च शामल न पर एह्दे तगर सीमित नेईं ऐ: परमात्मा दे कम्में, प्राकृतिक आपदाएं, महामारी जां महामारी, युद्ध, आतंकवाद, नागरिक अशांति, सरकारी कार्रवाईयां जां प्रतिबंध, मंजूरी, नाकाबंदी, श्रम विवाद, बिजली जां दूरसंचार विफलता, इंटरनेट जां नेटवर्क च गड़बड़ी, साइबर हमले, आपूर्ति श्रृंखला च गड़बड़ी, कानून जां नियम च बदलाव, जां कुसै होर घटना गी जेह् ड़ी उचित रूप कन्नै पूर्वानुमान नेईं कीती जाई सकदी ही जां नेईं रोकी सकदी ही।

31. सामान्य प्रावधान

31.1 पूरा समझौता

These Terms, together with the Privacy Policy, Cookie Policy, and any other policies or agreements referenced herein or agreed to by you, constitute the entire agreement between you and Foodfy concerning the Platform and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Foodfy regarding the Platform.

Foodfy may assign, transfer, or sublicense its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

The failure of Foodfy to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Foodfy.

31.6 कोई तृतीय पक्ष लाभार्थी नेईं

These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms, except as expressly provided herein.
